MobiTV, Inc. (“MobiTV”) owns and operates a service that enables the delivery of content across multiple screens, both inside and outside the home (the “MobiTV Service”). What information does MobiTV collect from its website?

MobiTV reserves the right to contact appropriate authorities and disclose Personal or Anonymous Information to them at its discretion when it appears that individuals using our products or services are engaged in activities that are illegal or violate the MobiTV Service Terms of Service. Should MobiTV merge with or be acquired by another company, or if the business unit providing your service were sold to another company, then customer information maintained by MobiTV, including Personal and Anonymous Information, may be transferred to and used by the resulting combined company. If MobiTV were to cease operations, this customer data might be transferred to and used by another company, which offers similar or related products or services. Is all of my information kept securely?
MobiTV utilizes a third party provider to store any Personal Information. Such provider is SSAE 16 certified and maintains a variety of physical, electronic and procedural safeguards to guard your information. All Personal and Anonymous Information is stored on physically and electronically secured servers. Access to this information is strictly limited to individuals with a legitimate reason to have access. The information is firewall protected against unauthorized access. While we cannot guarantee that loss, misuse or alteration of your data will not occur, we work hard to prevent such occurrences.

Does MobiTV collect Personal Information about children?
MobiTV is concerned about the safety and privacy of children and fully complies with the requirements of the Children‘s Online Privacy Protection Act of 1998. This website is not intended for or directed to persons under the age of 13, and MobiTV will not knowingly collect Personal Information at this website from anyone under such age. Any person who provides their information to MobiTV through this website represents to us that they are 13 years of age or older.

What about links to other sites?
This website may contain links to other sites that are not owned or controlled by MobiTV. Please be aware that MobiTV is not responsible for the privacy practices of such other sites. This Policy does not apply to information collected on the www.MobiTV.com website or to services provided by MobiTV through entities whose own privacy policy applies. YOUR PRIVACY IS IMPORTANT TO US

At MobiTV we are committed to maintaining the privacy of your personal information. This Privacy Policy describes how MobiTV uses information received about you when you provide information to us, and when you use the MobiTV Service.

WHAT INFORMATION DOES MOBITV COLLECT?

It is important to know that we collect different types of information. We use each type of information in different ways, as explained in more detail below. The terms defined below are used throughout our Privacy Policy.

“Personal Information” is information that identifies you as an individual. Examples of this data would be your name, address, telephone number, email address, and other information that identifies you uniquely.

“Location Information” is coarse information about the location of your device at a specific point in time. To the extent such information is utilized by the MobiTV Service it is not sufficiently granular to identify the street name of your location.

“Anonymous Information” is anonymous information about how people are using our Service, which is used without connecting it to any Personal Information.

“Aggregate Viewing Data” is one type of Anonymous Information. It is certain viewing information used by us to improve the MobiTV Service, such as which programs are viewed, the average data transfer rate, length of viewing sessions, and other similar data. Aggregate Viewing Data is data aggregated across users and therefore does not identify you as an individual.

“Collected Information” means Personal Information, Location Information, and Anonymous Information.

“VUID” means an identification number generated by wireless carriers to identify particular devices. In some cases the VUID is randomly generated, in others it is the Mobile Device Number (“MDN”), which is the phone number.

PERSONAL INFORMATION

The MobiTV Service collects the VUID and uses it to authenticate whether a device is subscribed to the MobiTV Service. To the extent that the VUID is an MDN, it may constitute Personal Information. Other than such limited case, we do not collect Personal Information unless you provide it to us voluntarily outside of the MobiTV Service, such as when you request promotional material, if you decide to complete customer surveys or participate in contests, or when you call our customer support line or otherwise interact with our employees or agents. The MobiTV Service does not collect Personal Information about an individual consumer’s online activities over time or across third-party Web sites or online services.

LOCATION INFORMATION

MobiTV may collect Location Information at the time you log into or open the MobiTV Service, and periodically during each viewing session. If we collect such information, we do not retain such information longer than is necessary for the use of such information, as described in the section “Use of Location Information” below, or as is required by our legal and/or contractual obligations. You may be asked by MobiTV Service for your consent to collect such Location Information. You may decline to provide consent for the collection and use of your Location Information; however, if you decline to provide your consent, you may not be able to continue to use the MobiTV Service at that time because we may need Location Information to verify that your location meets the geographic requirements for using the MobiTV Service. You may also opt out of such collection and use at any time by ending your use of the MobiTV Service. MobiTV follows CTIA’s Best Practices and Guidelines for Location-Based Services.

ANONYMOUS INFORMATION

MobiTV may collect Anonymous Information relating to the use of the MobiTV Service. For example, MobiTV’s servers automatically gather Aggregate Viewing Data. For network monitoring purposes, the MobiTV Service may also record how many devices in the aggregate are connected to the MobiTV Service in particular geographic locations.

Any Anonymous Information gathered from your use of the MobiTV Service will not be used in conjunction with your name or other Personal Information without your consent.

HOW DOES MOBITV USE THE INFORMATION IT COLLECTS?
USE OF PERSONAL INFORMATION

To the extent that the VUID is the MDN MobiTV collects and uses such information solely to operate and deliver the MobiTV Service. If you have provided Personal Information that you voluntarily provided to us, we will only use it in accordance with your authorization, for example to assist you with questions and resolve problems relating to your use of the MobiTV Service.

USE OF LOCATION INFORMATION

MobiTV may use Location Information to restrict viewing of content to its permitted geographic area and to enforce certain other geographic restrictions on viewing content, such as geographic blackouts for live sporting events.

USE OF ANONYMOUS INFORMATION

MobiTV uses Anonymous Information to effectively operate the MobiTV Service and enhance your experience using the MobiTV Service. For example, we may use Anonymous Information to diagnose and correct problems with the MobiTV Service and to optimize the performance of our computer network.

WITH WHOM DOES MOBITV SHARE THE INFORMATION THAT IS COLLECTED?
PERSONAL INFORMATION

MobiTV will not share your Personal Information with third parties without your consent, except in the very limited circumstances outlined in the Special Circumstances section below. Your Personal Information is not otherwise sold, marketed or shared with third parties without your permission.

LOCATION INFORMATION

We will not share your Location Information with third parties, except and only to the extent necessary to provide the MobiTV Service to you. We do not sell your Location Information or use it in any way not permitted by law.

ANONYMOUS INFORMATION

Anonymous Information may be shared with third parties for research, market analysis, or other similar purposes. We may also share Aggregate Viewing Data with third parties who supply us with programming for the MobiTV Service and with the wireless carriers associated with the MobiTV Service. MobiTV will only share Anonymous Information with third parties if the information is disclosed in a manner that does not identify individual subscribers to the third parties concerned.

ARE THERE ANY SPECIAL CIRCUMSTANCES THAT MAY REQUIRE MY INFORMATION TO BE SHARED WITH THIRD PARTIES?

MobiTV may disclose Collected Information if required to do so by law or in the good-faith belief that such action is necessary or appropriate to (a) comply with applicable laws or legal process served on MobiTV, (b) protect and defend the rights or property of MobiTV, the MobiTV Service, or the users of the MobiTV Service, whether or not required to do so by law, or (c) protect the personal safety of users of the MobiTV Service or the public. MobiTV reserves the right to contact appropriate authorities and disclose Collected Information to them when it appears that individuals using our products or services are engaged in activities that are illegal or violate the MobiTV Terms of Service and End-User License Agreement.

MobiTV may sell, transfer or otherwise share some or all of its assets, including Collected Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

From time to time, MobiTV may also share Collected Information with third parties for their use to provide services to MobiTV in the operation and delivery of the MobiTV Service. All such third parties are prohibited from use of such Collected Information except to provide such services to MobiTV.

DOES MOBITV COLLECT INFORMATION FROM CHILDREN UNDER 13?

MobiTV currently does not knowingly collect or use Personal Information from children under 13 except in compliance with the Child Online Privacy Protection Act (“COPPA”), and MobiTV will not do so in the future without first obtaining verifiable consent from their parents to the extent required by COPPA. Should a child whom MobiTV knows to be under 13 send Personal Information to MobiTV, MobiTV will only use that information to respond directly to that child or seek parental consent.

WHAT TYPES OF SECURITY MEASURES ARE IN PLACE TO PROTECT YOUR INFORMATION?

MobiTV maintains a variety of physical, electronic, and procedural safeguards to guard Collected Information. For example, such information resides on physically and electronically secured servers. In order to attempt to prevent unauthorized access into our systems, our servers sit behind an electronic firewall and are not directly connected to the Internet, and only authorized MobiTV employees or agents carrying out permitted business functions are permitted access. These technologies and methods, among others we use depending on the type of data being transmitted and/or stored, increase the security and privacy of information traveling to, from and within the MobiTV Service. While we cannot guarantee that loss, misuse or alteration of your data will not occur, we work hard to reduce the risk of such occurrences.

In addition, MobiTV encourages all users of the MobiTV Service to review the privacy policies posted by third party services, including those linked to or from the MobiTV Service, to ensure that these services also protect Personal Information.
