The MobiTv ESPN 3 on 3 promotion (the "Sweepstakes") begins at 12:00:01 AM EDT on May 1, 2008 and ends at 11:59:59 PM EST on June 6, 2008 (the "Sweepstakes Period"). THE SWEEPSTAKES IS GOVERNED BY U.S. LAW AND IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. VOID IN ALL U.S. TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED OR RESTRICTED BY LAW. The Sweepstakes is only open to individuals who are 16 years of age and older legal residents of the fifty United States (the "Eligibility Area") at the time of entry. The Sweepstakes shall be construed and evaluated according to United States law. Void outside the Eligibility Area and where prohibited.
1. How To Enter: Via Mobile: Use your AT&T phone to log on to the “Media Mall” section of the main menu and follow instructions to download ESPN Mobile TV on your mobile phone. Or, navigate to www.att.com/mediamall and follow instructions to download ESPN Mobile TV. You will receive one (1) automatic entry to the sweepstakes upon download. A subscription fee and standard data charges apply to download and use ESPN Mobile TV. You may incur significant data charges when using. A monthly subscription to a package that includes unlimited MEdia Net data plan is highly recommended.
2. To enter via mail without downloading ESPN Mobile TV: If you wish to enter without downloading ESPN Mobile TV, send a 3x5 card or piece of paper hand-written with your name, complete address, and daytime telephone number in a 3 x 5 card to : ESPN 3 on 3 Sweepstakes, P.O. Box 8022, Westport, CT 06888. All mailed entries must be postmarked by June 6, 2008 and received by June 12, 2008. Sponsor is not responsible for lost, late, incomplete, illegible, mutilated, invalid, unintelligible, misdirected or postage-due entries, which will be disqualified. No facsimiles, mechanical reproductions, alterations or forged entries will be accepted. All entries become the sole property of the Sponsor and receipt of those entries will not be acknowledged or returned.
3. Participation: Promotion is open to legal residents of the fifty United States, , 16 years of age or older (EXCLUDING WITHOUT LIMITATION, PUERTO RICO AND OTHER U.S. TERRITORIES AND FOREIGN TERITORRIES). Employees and their immediate families (parent, child, spouse, sibling) and household members of employees of Disney and ESPN Media Networks Affiliate Sales and Marketing, Inc., MobiTV, Inc., AT&T Mobility, LLC and their respective affiliated and parent companies, advertising and promotion agencies and anyone involved in this promotion’s production, development or handling are not eligible. This Promotion is subject to all federal, state and local laws and regulations.
4. Validation: All eligible entries received during the entire promotion will be entered into a grand prize random drawing, to be conducted on or about June 13, 2008 in Westport, Connecticut by The Concept Studio, LLC, an independent judging organization, whose decisions are final on all aspects of the promotion. All submissions are subject to validation by the judging organization. By entering, you agree to be bound by these Official Rules and all decisions of the judging organization. Potential Grand Prize winner will be notified via telephone and/or e-mail and may be required to sign and return, within 2 business days after delivery to his/her address, an Affidavit of Compliance with these Official Rules, a Prize/Travel Release and a Publicity Release for use of his/her name, likeness, biographical information without further compensation unless prohibited by law. Failure to sign and return these forms postmarked within 2 business days may result in forfeiture of prize and selection of an alternate winner. Entry materials void if incomplete or if they contain errors. All submissions become property of Sponsor.
- Prize and Odds: One (1) Grand Prize: A trip for winner and two (2) guests to the ESPN campus in Bristol, CT on June 27, 2008 for a 3 on 3 Basketball game with current basketball stars. Trip includes round-trip coach air transportation for three (3) between Hartford, CT and principal gateway airport nearest winner’s home; ground transportation between airport and hotel; 2-nights accommodations at sponsor-selected hotel; ground transportation between hotel and basketball session; and a basketball session with three (3) basketball greats (ARV: $4,500 ). Odds of winning depend on number of entries received.
- Prize Restrictions. Winner of Grand Prize must travel on designated days to coincide with basketball session schedule currently of June 27, 2008, which may change. Winner and travel companion must travel on the same date(s) and on the same itinerary. No changes or substitutions. If any prize becomes unavailable, Sponsor may award substitute of equal or greater value. No responsibility is assumed for postponement or cancellation of session. In the event of postponement or cancellation of basketball session after travel has been booked, remainder of trip will be awarded as complete prize. All federal, state and local taxes for receipt of any prize are sole responsibilities of Winner. Telephone calls, meals, gratuities, incidental hotel and personal expenses and all other expenses not specified herein are the responsibility solely of winner. All arrangements are subject to change, availability, holiday, blackout dates and other restrictions. Trip arrangements cannot be changed by potential Prize winners/travel companions. Potential Grand Prize winners must respond promptly to Sponsor's requests regarding travel arrangements. Grand Prize winners/travel companions must provide own transportation to/from airport of departure. If winner lives within 100 miles of the ESPN Campus in CT, roundtrip limo service will be awarded in lieu of airfare and the difference in the value between the ground transportation and airfare flights will not be awarded. If the winner is unable to travel on designated dates, the prize will be forfeited and an alternate winner will be selected from all remaining eligible entries received provided sufficient time remains prior to prize event. Trip prize (or any portion thereof) may not be sold, traded, transferred, assigned, refunded, or redeemed for cash and cannot be rescheduled. Grand Prize winners/travels companion are solely responsible for obtaining any/all necessary travel documentation/requirements (including but not limited to valid photo I.D., passport, etc.) before departure. Prizes are not valid for upgrades. All tickets issued in conjunction with the prizes are not eligible for frequent flyer miles. If potential Grand Prize winner chooses to not take a travel companion, then the travel companion elements will be forfeited and the remaining elements shall constitute full satisfaction of the Grand Prize. If Grand Prize winner is a minor, their travel companion must be a parent or legal guardian and each will be required to execute and return a liability/publicity release (unless prohibited by law) prior to ticketing. If prize winner is a minor under applicable state law, prize may be awarded in name of parent or legal guardian.
7. General Conditions: By entering, you agree to release, discharge and hold harmless Disney and ESPN Media Networks Affiliate Sales and Marketing, Inc., MobiTV, Inc., AT&T Mobility, LLC and their respective affiliated and parent companies, advertising and promotion agencies from all claims or damages arising out of your participation in this promotion and/or acceptance, ownership or use of any prize or prize related activity. Sponsor does not provide any implied or express warranty, guarantee or representation, in law or equity, pertaining any third party product or service supplied in whole or in part as a prize for this promotion. If for any reason any electronic portion of the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the promotion, to disqualify any individual who tampers with any entry process, and to award prizes among eligible entries not affected by the problem. In case of any dispute regarding identity of person submitting an electronic entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting email address or text messaging device/service at the time of entry. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, busy signals, communication network failure, theft or destruction or unauthorized access to, or alteration of entries; or any problems or technical malfunctions of any wireless or wired telephone network, computer online systems, servers, or providers, computer equipment, software; or failure of any entry to be received on account of technical problems or traffic congestion on any telephone or internet connection, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from participation in or downloading any materials from this promotion. - DISPUTES: Participant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the State of New York. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with federal law and to the extent not inconsistent, the laws of the State of New York.
- Information collected in connection with this Sweepstakes will be used in accordance with AT&T privacy policy, and these Official Rules. In the event of any discrepancy between the privacy policy and these Official Rules, the privacy policy shall control and govern. Personally identifiable information that is submitted by entrants as part of the Sweepstakes will be used to administer the Sweepstakes, select prize winners, and fulfill prizes.
